Customs Classification Dispute — Electronics Importer

The Situation

A Kuala Lumpur-based electronics importer received a post-import audit notice from RMCD, challenging their tariff classification for a category of components. A significant duty difference was in dispute.

Our Involvement

We reviewed the classification history, technical specifications, and applicable Harmonised System notes. A formal written response was prepared and submitted on behalf of the client, supported by technical references.

Outcome

RMCD accepted the classification argument and the duty assessment was revised in favour of the importer. The matter was resolved within three months of engagement.

Non-Profit Incorporation — Environmental Community Group

The Situation

A group of environmental advocates in Klang Valley wanted to formalise their organisation to enable donor partnerships and apply for grants. They had no prior experience with Malaysian non-profit registration.

Our Involvement

We advised on the most appropriate registration structure, drafted the constitution and governance documents, filed the incorporation, and supported the tax-exempt application to LHDN.

Outcome

The organisation was incorporated within six weeks and the tax-exempt application was submitted. They subsequently entered into their first institutional donor agreement within the same year.

Criminal Defence — Regulatory Charge Against a Sole Trader

The Situation

A self-employed individual faced a criminal charge under a regulatory statute arising from a licensing dispute. The client had not previously engaged a lawyer and was unfamiliar with court procedures.

Our Involvement

We reviewed the charge and the evidence disclosed by the prosecution, prepared the client for proceedings, and appeared in the sessions court throughout. The client was kept informed at every stage.

Outcome

Following trial, the client was acquitted. The full duration from initial consultation to acquittal was approximately seven months, in line with the estimated timeline given at engagement.
