Please read these Terms and Conditions carefully before using this website or engaging Fenworth's legal services. By accessing this website or instructing us to act on your behalf, you accept these terms.

1. Interpretation

In these Terms and Conditions, the following definitions apply:

  • "Client" — an individual or entity that has formally engaged Fenworth under a written retainer or letter of engagement.

  • "Services" — legal services provided by Fenworth as set out in the applicable letter of engagement.

2. Use of This Website

This Website is available for general information purposes. You agree not to:

  • Use this Website in any way that violates applicable Malaysian or other law.

No lawyer-client relationship is created by use of this Website or by submitting an enquiry through the contact form. A formal engagement is established only upon execution of a written retainer or letter of engagement signed by Fenworth and the Client.

4. Engagement of Services

All legal services provided by Fenworth are governed by the terms in the letter of engagement issued at the commencement of instructions. In the event of conflict between these Terms and the letter of engagement, the letter of engagement shall prevail.

Fenworth reserves the right to decline instructions where there is a conflict of interest, where the matter falls outside our practice areas, or where we consider acceptance otherwise inappropriate.

Clients are expected to provide accurate and complete information. Fenworth accepts no responsibility for consequences arising from incomplete or inaccurate information provided by a Client.

5. Fees and Payment

Fees are set out in the applicable letter of engagement. Indicative fees on this Website are starting points only and subject to revision based on scope and complexity.

Unless otherwise agreed in writing, invoices are payable within fourteen (14) days of issue. Fenworth reserves the right to suspend work on a matter where fees remain outstanding.

Disbursements and third-party costs will be communicated to the Client in advance where practicable and are payable in addition to professional fees.

6. Confidentiality

Fenworth is bound by the professional conduct rules of the Malaysian Bar Council. Communications between a Client and Fenworth within a legal engagement are protected by legal professional privilege to the extent recognised under Malaysian law.

Enquiries submitted through the Website contact form before a formal engagement are treated with discretion but may not attract privilege until a retainer is in place.

7. Intellectual Property

All content on this Website is the property of Fenworth or its licensors and is protected under applicable intellectual property law. No part of this Website may be reproduced, distributed, or transmitted without prior written permission, except for personal, non-commercial reference.

8. Limitation of Liability

To the extent permitted by law, Fenworth excludes all liability for any loss or damage arising from reliance on information published on this Website.

Nothing in these terms limits Fenworth's liability for matters that cannot be excluded under Malaysian law, including claims arising from professional negligence within a formal engagement.

10. Termination of Engagement

Either party may terminate a legal engagement by giving reasonable written notice, subject to the letter of engagement. Termination does not affect accrued rights or obligations at the time of termination.

Upon termination, Fenworth will provide the Client with copies of all documents held on their behalf, subject to any lien in respect of outstanding fees.

11. Governing Law

These Terms and Conditions are governed by the laws of Malaysia. Any dispute shall be subject to the exclusive jurisdiction of the courts of Malaysia.

12. Amendments

Fenworth may update these Terms from time to time. The revised version will be posted on this page with an updated effective date. Continued use of this Website after any update constitutes acceptance of the revised terms.
